Stamp Duty for overseas buyers: common questions

How much Stamp Duty do non-UK residents pay?

Non-UK residents pay the standard rates plus a 2% surcharge. If they will own another home anywhere in the world after the purchase — including in the Gulf — a further 5% applies. On a £250,000 apartment that usually means £20,000.

Who counts as a non-UK resident for Stamp Duty?

Anyone who has spent fewer than 183 days in the UK in the 12 months before buying. If any joint buyer is non-resident, the whole purchase is treated as non-resident.

Does owning a home in Kuwait or the UAE count?

Yes. The 5% surcharge applies if you will own another residential property worth £40,000 or more anywhere in the world once the purchase completes.

Can I get the 2% surcharge back?

Usually, if you spend at least 183 days in the UK in a 365-day period that ends no later than a year after completion. Your solicitor can claim the refund from HMRC.

When is Stamp Duty paid?

Your solicitor files the return and pays the tax to HMRC within 14 days of completion, usually from funds you send before completion.
